Treatises

Secondary Legal / Area of Law Treatises / xxx

Each Treatise is listed individually; treatises cannot be searched as a group. A treatise is a written composition on a particular subject, in which its principles are discussed or explained. Legal treatises usually focus on a complete area of law, with discussions of particular legal issues within.

Each article analyzes and evaluates case law on a particular subject. A description or an overview of a particularCases from all jurisdictions that have ruled on the relevant issue are collected and analyzed in the article.

Restatements of Law


Secondary Legal / ALI Restatements of Law

Each Restatement is the product of years of discussion, analysis and revision by the members of the American Law Institute. Acknowledged experts in a given subject matter endeavor to capture the common law in a 'statutory' like format. The Restatement on each subject expresses as nearly as possible the rules that courts will apply. These rules govern not only situations that have already arisen in specific cases, but by analogy all rules that would apply in situations that may arise for the first time.

The Annotated Case Citations that are linked to each rule, give analysis and a summary of treatment accorded a Restatement Rule in specific situations. Each Citation is also linked to the full text of the case. Each Restatement subject contains an online functional Table of Contents, Rules, Comments and Notes documents and Annotated Case Citations. Within a subject, the Table of Contents, Rules and Citations are linked together to provide ease of use and better research results.
